for epok.com and epok.mobi. We will try to
keep the terms as short as possible and in
plain English. Please read them carefully
because, by using epok.com and/or epok.mobi,
you agree to be legally bound by these
terms, which shall take effect immediately
on your first use of our services.
We may change these terms at any time by
posting changes online at www.epok.com. Your
continued use of epok.com and or epok.mobi
after changes are posted means you agree to
be legally bound by the new terms.
Privacy
If you're
like us, your privacy is important to you.
This is why we do not ask you to register or
provide us with any of your personal
details. All we require is that you provide
a username if you want to do reviews. We
follow a strict anti-spam policy and we never pass any of your details to third
parties. The only exception to that is if we
have to for legal reasons.
Once a month we
may send you one email about restaurants to try.
Eligibility and use
You must be at least 18 years of age to use
epok.com and/or epok.mobi.
You may not copy, reproduce, republish,
download, post, broadcast, transmit, make
available to the public or in any other way
use epok.com and/or epok.mobi content in any
way except for your own personal,
non-commercial use. You also agree not to
adapt, alter or create a derivative work
from any epok.com and/or epok.mobi content
except for your own personal, non-commercial
use. Any other use of epok.com and/or
epok.mobi content requires our prior written
permission.
We
reserve the right to terminate your use of
our services at any time and at our
sole discretion.
Disclaimers and limitations of liability
Epok.com and epok.mobi content, including
the information, names, images, pictures,
logos and icons regarding or relating to
epok.com and epok.mobi, their products and
services (or regarding or relating to third
party products and services), is provided
"AS IS" and on an "IS AVAILABLE" basis
without any representations or any kind of
warranty being given or made (whether
express or implied by law) to the extent
permitted by law, including (but without
limitation) the implied warranties of
satisfactory quality, fitness for a
particular purpose, non-infringement,
compatibility, security and accuracy.
In particular (but without limitation),
under no circumstances will epok.com or
epok.mobi, our officers, employees or
agents be liable for any of the following
losses or damage (whether such losses were
foreseen, foreseeable, known or otherwise):
(a) loss of data; (b) loss of revenue or
anticipated profits; (c) loss of business;
(d) loss of opportunity; (e) loss of
goodwill or injury to reputation; (f) losses
suffered by third parties; or (g) any
indirect, consequential, special or
exemplary damages arising from the use of
epok.com and/or epok.mobi regardless of the
form of action.
Neither epok.com nor epok.mobi warrants
that services and functions contained in
epok.com and/or epok.mobi content will be
uninterrupted or error free, that defects
will be corrected, or that epok.com and/or
epok.mobi or the server that makes it
available are free of viruses or bugs.
Neither epok.com
nor epok.mobi will not be liable for
services provided by third parties linked or
displayed on the
epok.com and/or epok.mobi website
and takes no
responsibility for the accuracy of such
services.
Reviews
included on
epok.com and/or epok.mobi
represent the
views and opinions of users of
epok.com and/or epok.mobi
and are not
endorsed by us. We will not be held
responsible or liable for the accuracy of
such views and opinions.
If we are
unable to find a restaurant in an area that
you have nominated we will place a credit on
your name so that, if/when a restaurant does
become available, you will be able to use
the credit to get a discount on your meal.
Intellectual Property
The names, images and logos identifying
epok.com and/or epok.mobi or any third party
and their products and services are subject
to copyright. Nothing contained in these
terms shall be construed as conferring by
implication, estoppel or otherwise any
licence or right to use any trademark,
patent, design right or copyright of
epok.com and/or epok.mobi and/or any third party.
Contributions to
epok.com and/or epok.mobi
Where you are invited to submit any
contribution to epok.com and/or epok.mobi
(including any text, photograph, graphics,
video or audio) you agree, by submitting
your contribution, to grant epok.com and/or
epok.mobi a perpetual, royalty-free,
non-exclusive, sub-licenseable right and
license to use, reproduce, modify, adapt,
publish, translate, create derivative works
from, distribute, perform, play, make
available to the public, and exercise all
copyright and publicity rights with respect
to your contribution worldwide and/or to
incorporate your contribution in other works
in any media now known or later developed
for the full term of any rights that may
exist in your contribution.
Also by submitting your contribution to
epok.com and/or epok.mobi, you warrant that
your contribution is your own original work
and that you have the right to make it
available for all the purposes specified
above, is not defamatory, does not infringe
any law; and you agree to indemnify epok.com
and/or epok.mobi against all legal fees,
damages and other expenses that may be
incurred by epok.com and/or epok.mobi as a
result of your breach of the above
warranties and waive any moral rights in
your contribution for the purposes of its
submission to, and publication on, epok.com
and/or epok.mobi and the purposes specified
above.
If you post or send offensive or
inappropriate content anywhere on, or to,
epok.com and/or epok.mobi, or otherwise
engage in any disruptive behaviour on
epok.com and/or epok.mobi, and we consider
such behaviour to be serious and/or
repeated, we may use whatever information is
available about you to stop any further such
behaviour. This may include informing
relevant third parties such as your mobile
operator or email provider.
We reserve the right to decline reviews
submitted, delete any
contribution, or take action against any
account, at any time, for any reason.
Free
Meals Offer/Up to 50% Offer
The free
meal offer relates to a 2 for 1 deal
or 50% off covering at least 2 courses (one must be a
main course with the lowest or equal priced
dish of each course being free) for at least
2 people. Excludes drinks and service
charge. Includes VAT. Bookings must be made
by phone to the restaurant quoting the EPok
offer.
Miscellaneous
If any of these terms are determined to be
illegal, invalid or otherwise then, to the extent
to which that term is
illegal, invalid or unenforceable, it shall
be severed and deleted from these terms and
the remaining terms shall survive, remain in
full force and effect and continue to be
binding and enforceable.
These terms shall be governed by, and
interpreted in accordance with, the laws of
England and Wales.
The
Courts of England and Wales shall have
exclusive jurisdiction over all claims or
disputes arising in relation to, out of, or
in connection with these terms and our
websites. |
